These Terms govern your access to and use of BuyThe200.com — a research and educational platform built around the 200-week simple moving average. Read them carefully: by using this site, you agree to be bound by every section below.

01 Who we are

BuyThe200.com (the “Site,” “Service,” “we,” “us,” or “our”) is owned and operated by Kernel Media, a company registered in the Province of British Columbia, Canada. References to “BuyThe200” in this document mean Kernel Media acting in connection with the Site.

02 Acceptance of Terms

By accessing, browsing, or otherwise using the Site — whether you create alert preferences, view charts, or simply load a page — you confirm that you have read, understood, and agreed to be legally bound by these Terms of Use and our Privacy Policy. If you do not agree, you must stop using the Site immediately.

These Terms form a binding contract between you and Kernel Media. They apply whether you use BuyThe200 from a desktop, mobile device, or any embedded view.

03 Nature of the service

BuyThe200 publishes technical research content centered on the 200-week simple moving average (SMA), a long-term trend metric popularized in public commentary by Charles T. Munger. The Site provides:

  • Charts and visualizations of historical price data relative to the 200-week SMA;
  • A live scanner that flags publicly-traded equities trading near their 200-week SMA;
  • Backtests of mechanical entry rules using historical data;
  • Optional email and (where configured) SMS alerts when an equity approaches its 200-week SMA;
  • Articles, commentary, and educational write-ups on the underlying methodology.

The Service is provided as commentary and information only. We are not a broker-dealer, investment adviser, financial planner, or fiduciary in any jurisdiction. We are not registered with the SEC, FINRA, the CSA, the BCSC, the FCA, ASIC, or any other securities regulator, and we do not hold any license to provide personalized investment advice.

Nothing on BuyThe200.com constitutes financial, investment, tax, accounting, or legal advice. No content here — including signals, scanner output, backtests, articles, alerts, charts, or commentary — is a recommendation, solicitation, or offer to buy or sell any security, derivative, or other financial instrument.

You acknowledge and agree that:

  1. Past performance is not indicative of future results. Backtests are hypothetical, do not reflect actual trading, and may not account for slippage, commissions, taxes, dividends, survivorship bias, or look-ahead bias.
  2. The 200-week SMA is one indicator among many. A stock trading at or below its 200-week SMA may continue to decline indefinitely. There is no statistical or economic guarantee that the SMA will act as support.
  3. Markets carry inherent risk. You may lose some or all of any capital you invest. Investing in equities, options, futures, and similar instruments involves substantial risk and is not appropriate for every person.
  4. You are solely responsible for your own due diligence, suitability assessment, and any resulting trades.
  5. Consult a licensed professional — a registered investment adviser, a CPA, or qualified counsel in your jurisdiction — before acting on anything you read on this Site.

05 Data accuracy & sources

Quote, chart, and historical price data on BuyThe200 is sourced primarily from Yahoo Finance via its public APIs, retrieved through a server-side proxy maintained by Kernel Media. Data is cached for short periods (typically 15 minutes for quotes, 24 hours for weekly history) to manage upstream rate limits.

We make no warranty that quotes, calculations, or historical figures shown are accurate, complete, or current. Data may be delayed, missing, mis-symbolized, corrupted in transit, or simply wrong. Do not rely on any number shown on BuyThe200 as a primary input for a real trade. Cross-check with your broker before transacting.

06 Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to use the Site. By using BuyThe200 you represent that you meet this requirement and that your use does not violate any law applicable to you. The Site is not directed at residents of any jurisdiction where its content would constitute the unlicensed provision of investment advice.

07 Acceptable use

You agree that you will not:

  • Scrape, harvest, or systematically copy data from the Site beyond casual personal use;
  • Use automated tooling (bots, crawlers, headless browsers) to load pages or query endpoints at a rate that imposes a measurable load on our infrastructure or upstream providers;
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service beyond what is publicly visible in your browser;
  • Bypass, disable, or circumvent any rate-limit, cache, authentication, or access control;
  • Use the Site to transmit malware, spam, or unlawful content;
  • Hold yourself out as affiliated with, endorsed by, or speaking on behalf of Kernel Media;
  • Use the Site in violation of any applicable law or regulation.

08 Intellectual property

All original content on the Site — including text, design, layout, graphics, logos, article copy, the BuyThe200 wordmark, source code, and the editorial selection and arrangement of data — is the property of Kernel Media or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

Quote and chart data displayed through the Site is the property of its respective data providers (e.g., Yahoo Finance, the originating exchanges) and is shown for personal, non-commercial reference. You receive a limited, revocable, non-exclusive, non-transferable license to access and view content on the Site for personal, non-commercial use only. All other rights are reserved.

09 User-submitted content

If you submit any feedback, suggestion, idea, or other content to us — through the alert configuration form, comments, email, or any other channel — you grant Kernel Media a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, and display that content in connection with operating and improving the Service. You represent that you have the right to grant this license.

10 Third-party services & links

The Site may link to, embed, or rely on third-party services, including but not limited to Yahoo Finance, Google Fonts, Twilio (for SMS delivery, when configured), and various publicly-listed exchange websites. We do not control these third parties, do not endorse their content, and are not responsible for their availability, accuracy, terms, or privacy practices. Your use of any third-party service is governed by that service’s terms.

11 Email & SMS alerts

If you opt in to email or SMS alerts:

  • You consent to receive automated messages at the address or phone number you provide;
  • Standard message and data rates may apply to SMS, levied by your carrier — not by us;
  • Alert delivery is best-effort and not guaranteed. Messages may be delayed, deduplicated, rate-limited, blocked by carrier filters, or fail to send for reasons outside our control;
  • You may unsubscribe at any time by clearing the alert configuration on the Site, or by replying STOP to any SMS;
  • Alerts are informational only and are subject to all the disclaimers in Section 4.

12 Disclaimer of warranties

The Site is provided on an “as-is” and “as-available” basis. To the maximum extent permitted by applicable law, Kernel Media disclaims all warranties of any kind, whether express, implied, statutory, or otherwise — including, without limitation, warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, completeness, or uninterrupted operation.

We do not warrant that the Site will be available at any particular time, that defects will be corrected, that the Site will be free of viruses or other harmful components, or that any signal, scanner result, or backtest is accurate, reliable, or suitable for any purpose.

13 Limitation of liability

To the maximum extent permitted by law, in no event will Kernel Media, its directors, officers, employees, contractors, or affiliates be liable to you or any third party for any indirect, incidental, consequential, special, exemplary, or punitive damages — including lost profits, lost trading opportunities, loss of data, or loss of goodwill — arising out of or relating to your use of the Site, even if we have been advised of the possibility of such damages.

Where applicable law does not permit a full disclaimer of liability, our total aggregate liability to you for any and all claims arising out of or relating to the Site or these Terms is limited to one hundred Canadian dollars (CAD $100).

14 Indemnification

You agree to defend, indemnify, and hold harmless Kernel Media and its directors, officers, employees, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with (i) your access to or use of the Site, (ii) your violation of these Terms, (iii) your violation of any law or third-party right, or (iv) any trade or financial decision you make in reliance on content from the Site.

15 Termination

We may suspend, restrict, or terminate your access to the Site at any time, for any reason or no reason, with or without notice, including for violations of these Terms. All sections of these Terms that by their nature should survive termination — including without limitation Sections 8 (IP), 12 (Warranties), 13 (Liability), 14 (Indemnification), 16 (Governing Law), and 17 (Disputes) — will survive.

16 Governing law

These Terms and any dispute arising out of or in connection with them or the Site are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

17 Dispute resolution

Before initiating any formal proceeding, you agree to first contact us at the address in Section 20 and attempt in good faith to resolve any dispute informally for at least thirty (30) days.

If we cannot resolve the dispute informally, you and Kernel Media each consent to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, and waive any objection to venue or forum in those courts. To the maximum extent permitted by law, you waive any right to participate in a class action, class arbitration, or other consolidated proceeding against us.

18 Changes to these Terms

We may revise these Terms from time to time. The “Last revised” date at the top of this page reflects the most recent change. Material changes will be highlighted on the Site for a reasonable period. Your continued use of the Site after a revision constitutes acceptance of the revised Terms.

19 Severability & miscellaneous

  • Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force.
  • No waiver. Our failure to enforce any right is not a waiver of that right.
  • Assignment. You may not assign these Terms without our written consent. We may assign them freely, including to a successor or acquirer.
  • Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kernel Media regarding the Site.
  • Headings. Section headings are for convenience only.
  • Force majeure. We are not liable for delays or failures due to causes beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, carrier failures, or upstream API outages.
